Criminal Law consists of laws and procedures whose purpose is to establish a system of prohibitions, penalties and correctional measures to deal with conduct which unjustifiably and inexcusably causes or threatens harm to those individuals or public interests for which protection is appropriate.
The laws and procedures are intended to achieve the following objectives. One, to insure the public safety, be it by deterrence, rehabilitation or punishment. Two, by defining and grading criminal offenses to give fair warning of what is prohibited and the consequences of a violation of these rules. Three, to set penalties that are proportionate to the seriousness of the criminal offense. And four, to protect the innocent. The protection of the innocent includes to guide and limit the exercise the power by law enforcement to prevent arbitrary or oppressive treatment of persons suspected, accused or convicted of criminal offenses.
